The Uncontested Divorce Process.

• The required information is gathered from the parties.
• The divorce paperwork is drafted from the required information.
• The divorce paperwork is filed with the court.
• If children are involved, the parties must attend a transparenting class.
• The judge can sign the paperwork at any point after 30 days.
  • Alabama has a mandatory 30 day waiting period on divorces.

 The Contested Divorce Process.

• The required information is gathered from the party wanting to file the divorce.
• The attorney files a complaint with the court, which starts the divorce proceedings.
• The other spouse has 30 days in which to answer the complaint.
• Each party conducts discovery which can consist of such things as interrogatories and depositions.
  • Interrogatories are written questions which must be answered under oath.
  • Depositions are where the attorney asks the other party questions under oath in the presence of a court reporter.
• Temporary hearings may be required.
• The parties must attend a transparenting class.
• The case is set for trial.
• At trial the judge hears the evidence and makes a ruling based upon the evidence submitted.
